The following are considered violations of HyperFilter AUP<\/strong>\u00a0(Acceptable Use Policy):<\/p>

1. Illegal usage:<\/strong>\u00a0Use of the HyperFilter service for illegal purposes, or in support of illegal activities. HyperFilter reserves the right to cooperate with legal authorities and\/or injured third parties in the investigation of any suspected crime or civil wrongdoing.2. Threats:<\/strong>\u00a0Use of the HyperFilter service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.<\/p>

3. Harassment:<\/strong>\u00a0Use of the HyperFilter service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.<\/p>

4. Forgery or impersonation:<\/strong>\u00a0Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.<\/p>

5. Fraudulent activity:<\/strong>\u00a0Use of HyperFilter service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as \u201cpyramid schemes\u201d and \u201cchain letters.\u201d<\/p>

6. Unsolicited commercial e-mail \/ Unsolicited bulk e- mail (SPAM):<\/strong>\u00a0Use of the HyperFilter service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending HyperFilter account.<\/p>

IMPORTANT NOTICE
Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove ANY and ALL traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been COMPLETELY removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation WILL be immediately and permanently removed from our network without notice.<\/p>

7. E-mail \/ News Bombing:<\/strong>\u00a0Malicious intent to impede another person\u2019s use of electronic mail services or news will result in the immediate termination of the offending HyperFilter account.<\/p>

8. E-mail \/ Message Forging:<\/strong>\u00a0Forging any message header, in part or whole, of any electronic transmission, originating or passing through the HyperFilter service is in violation of this AUP.<\/p>

9. Usenet Spamming:<\/strong>\u00a0HyperFilter has a zero tolerance policy for the use of its network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.<\/p>

10. Unauthorized access:<\/strong>\u00a0Use of the HyperFilter service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of HyperFilter\u2019s or another entity\u2019s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending HyperFilter account is subject to immediate termination.<\/p>

11. Copyright or trademark infringement:<\/strong>\u00a0Use of the HyperFilter service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.<\/p>

12. Collection\/Advertisement of personal data:<\/strong>\u00a0Use of the HyperFilter service to collect, or attempt to collect or even advertise personal<\/p><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\r\n\t\t

13. Network disruptions and unfriendly activity:<\/strong>\u00a0Use of the HyperFilter service for any activity which affects the ability of other people or systems to use HyperFilter Services or the Internet. This includes \u201cdenial of service\u201d (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member\u2019s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and\/or use of another company and\/or individual\u2019s computer system will result in immediate account termination. HyperFilter will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.<\/p>

14. Fraud:<\/strong>\u00a0Involves a knowing misrepresentation or misleading state- ment, writing or activity made with the intent that the person receiving it will act upon it.<\/p>

15. Infringement:<\/strong>\u00a0of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and\/or posting of copyrighted or the aforementioned infringements will not be tolerated.<\/p>

16. Distribution of Viruses:<\/strong>\u00a0Intentional distributions of software that attempts to and\/or causes damage, harassment, or annoyance to persons, data, and\/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.<\/p>

17. Inappropriate Use of Software:<\/strong>\u00a0Use of software or any device that would facilitate a continued connection, i.e. pinging, while using HyperFilter services could result in suspension service.<\/p>

18. Third Party Accountability:<\/strong>\u00a0HyperFilter subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within the Acceptable Use Policy.<\/p>

19. Adult content:<\/strong>\u00a0Adult content is allowed.<\/p>

20. IP Addresses:<\/strong>\u00a0Using IP addresses that were not assigned by HyperFilter.<\/p>

21. Support to Terrorists:<\/strong>\u00a0Using HyperFilter services to provide support or resources (including concealing or disguising the nature, location, source, or ownership of support or resources) to any organization designated by the U.S. government as a terrorist organization pursuant Section 219 of the Immigration and Nationality Act.<\/p>

22. Gambling:<\/strong>\u00a0Using HyperFilter services for or to promote gambling that is or may be prohibited or restricted by any state or federal gambling laws or regulations.<\/p>

23. Affiliates:<\/strong>\u00a0Our affiliates must be working ethically with us, in case the referred customers are moved to companies handled by the affiliates, we reserve our rights, the affiliate agreement is cancelled and commission credits are removed (without any prior notice), moving customers to affiliates related companies will be authorized only after at least 1 year without any activated related with us and no further commissions being received.<\/p>

24. Harm to Minors \/ Child Pornography:<\/strong>\u00a0Using HyperFilter services to harm minors in any way or transmitting (by email, uploading, posting or otherwise), distributing, downloading, copying, caching, hosting or storing on a server any child pornography as defined by U.S. law. Adult content is allowed.<\/p>

25. Violation of Security:<\/strong>\u00a0Violating or attempting to violate the security of HyperFilter\u2019s systems.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

HyperFilter DDoS Protection Solutions (\u201cHyperFilter<\/strong>\u201c) agrees to furnish services to the Subscriber, subject to the following TOS (Terms of Service).<\/p>

Use of\u00a0HyperFilter<\/strong>\u00a0Service constitutes acceptance and agreement to HyperFilter\u2019s AUP as well as HyperFilter\u2019s TOS (Terms of Service).<\/p>

All provisions of this contract are subject to the TOS (Terms of Service) of HyperFilter. and AUP (acceptable use policy). The AUP may be changed from time to time at the discretion of the Company. Subscriber understands that change to the AUP by the Company shall not be grounds for early contract termination or non-payment.<\/p>

This Agreement shall be construed in all respects in accordance with the laws of the state of Illinois, Cook County applicable to contracts enforceable in that state. Venue will be Cook County, Illinois<\/p>

1. Disclosure:<\/strong>\u00a0The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition HyperFilter shall have the right to terminate all service set forth in this Agreement.<\/p>

2. Service Rates:<\/strong>\u00a0Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that the Company may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon Company achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.<\/p>

3. Payment:<\/strong>\u00a0Establishment of this service is dependent upon receipt by the Company of payment of stated charges. Subsequent payments are due on the anniversary date of the month for that month\u2019s service. Subscriber agrees that HyperFilter automatically charges subscriber credit card every month. HyperFilter reserves the right to process client credit cards from 1 to 5 days before the actual due date to ensure that the funds are received by the due date. It is important to understand that all the payments must come from the customer itself and not from third parties, failure to do so may result in suspension of the services.<\/p>

4. Payments:<\/strong>\u00a0Service will be interrupted on invoices that reach 24 hours (1 day) past due. If you desire to cancel your service, please follow the proper procedure to do this as outlined in this TOS. Any of HyperFilter Services will be considered abandoned and forfeited after 5 days past due, resulting in service termination without further notices. Any dispute or claim open in any payment gateway, will result in instantly suspension of the service until the subject is solved by the customer without any warning.<\/p>

5. Refund and Disputes:<\/strong>\u00a0All payments to HyperFilter. are nonrefundable. This includes the one time setup fee(if that is any) and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred. If you dispute a charge to your credit card issuer that, in HyperFilter\u2019s sole discretion is a valid charge under the provisions of the TOS and \/or AUP, you agree to pay HyperFilter an \u201cAdministrative Fee\u201d of not less than $50 and not more than $150. If a dispute or claim gets open instead of properly requesting the cancellation of the services, all the services related with the company are going to be completely terminated without further notice as this is a direct violation for the pre-paid model of all our services. We also reserve in our rights to do not accept any other services to be ordered from the offending customer.<\/p>
